INDIAN CONSTITUTION & POLITY → EDUCATIONAL PROVISIONS & SERVICE SAFEGUARDS

1

CONCEPT 1: THE "EDUCATION TRIUMVIRATE" (86th AMENDMENT, 2002)

CORE RULE: 86th Amendment spread education across 3 parts of the Constitution.
86th AMENDMENT (2002)
⬇
↙ ⬇ ↘
FUNDAMENTAL RIGHTS
Art. 21A
Free & Compulsory Education to all children
6 - 14 years
DIRECTIVE PRINCIPLES
Art. 45 (Amended)
Early Childhood Care & Education (ECCE) for all children
0 - 6 years
FUNDAMENTAL DUTY
Art. 51A(k)
Parent/Guardian to provide opportunities of education to child
6 - 14 years
MNEMONIC → "0 to 6 (State's DUTY), 6 to 14 (Child's RIGHT), 6 to 14 (Parent's DUTY)"
⚠ UPSC TRAP / WATCH OUT:

PYQ: Which Article directs the State to provide Early Childhood Care & Education (ECCE) for a 4-year-old child?

Distractor: Article 21A

Strict Answer: ARTICLE 45 (DPSP)

Why? Art. 21A starts only from age 6.

2

CONCEPT 2: MINORITY EDUCATIONAL INSTITUTIONS (ARTS. 29 & 30)

CORE RULE: Constitution gives special autonomy to religious & linguistic minorities.
MINORITY RIGHTS
⬇
↙ ⬇ ↘
Art. 29
Protects the right of any section of citizens having a distinct language, script or culture to conserve it.
Art. 30(1)
All minorities (based on religion OR language) have the right to establish and administer educational institutions of their choice.
Art. 28
Ban on religious instruction in any educational institution wholly maintained out of State funds.
EXCEPTION:
If the institution is administered by the State BUT established under an endowment / trust requiring religious instruction, the ban does NOT apply.
SUPREME COURT (Pramati Case, 2014)
RTE Act 2009 (including 25% EWS quota & SMC mandates) is NOT applicable to both aided & unaided Minority Educational Institutions.
⚠ UPSC TRAP / WATCH OUT:

Scenario: A linguistic minority school (aided by State) is ordered by DEO to reserve 25% seats for EWS under RTE. Is the order valid?

Strict Answer: NO.

Why? Minority institutions are constitutionally protected under Art. 30 and are EXEMPT from RTE Act mandates, even if they receive State aid.

3

CONCEPT 3: THE 7TH SCHEDULE & THE CONCURRENT LIST

ORIGINAL POSITION
Education was a
STATE SUBJECT
(List II - State List).
→
42nd AMENDMENT ACT (1976)
Shifted 5 subjects (including Education & Weights & Measures) to the
CONCURRENT LIST (List III).
→
PRESENT POSITION
Both Parliament (Union) & State Legislatures can make laws on education.
→
IN CASE OF CONFLICT
Central Law PREVAILS over State Law.
e.g., RTE Act prevails over any conflicting State law.
MNEMONIC → "42 brings Education to the Centre (Concurrent List)"
⚠ UPSC TRAP / WATCH OUT:

PYQ: Which amendment made uniform national policies like NPE 1986 & NEP 2020 legally feasible across India?

Distractor: 86th Amendment

Strict Answer: 42nd AMENDMENT (1976)

Why? Because it moved education to the Concurrent List, giving Centre the legal jurisdiction.

4

CONCEPT 4: SAFEGUARDS FOR CIVIL SERVANTS (ARTICLE 311)

CORE RULE: Provides 2 absolute constitutional safeguards against arbitrary dismissal from service.
ARTICLE 311
⬇
↙ ↘
SAFEGUARD 1
(Subordinate Authority Bar)
A civil servant cannot be dismissed/removed by an authority SUBORDINATE to that by which they were appointed.
e.g., If appointed by Director, a Deputy Director cannot dismiss.
SAFEGUARD 2
(Right to be Heard)
No civil servant can be dismissed, removed or reduced in rank except after an inquiry in which he has been informed of the charges and given a reasonable opportunity of being heard.
(Principle of Natural Justice)
EXCEPTIONS
Inquiry can be bypassed if:
  • Civil servant is convicted on a criminal charge.
  • President/Governor decides that inquiry is not expedient in the interest of State security.
⚠ UPSC TRAP / WATCH OUT:

Scenario: PGT appointed by DoE misbehaves. School Principal immediately issues termination order.

Is it legal?

Strict Answer: NO. NULL & VOID under Art. 311.

Why?
• Principal is SUBORDINATE to appointing authority (DoE).
• Principal can only SUSPEND & recommend inquiry, not dismiss.
