1

Leave Encashment and Earned Leave (EL) Ceilings

Core Principle/Rule: Earned Leave is statutory leave that accumulates over an employee’s service period up to a strict administrative ceiling, and its cash equivalent can be claimed at retirement.

Key Facts:

  • Credit Rate: 15 days of EL are credited in advance on 1 January and 1 July each year, totalling 30 days annually.
  • Accumulation Ceiling: The maximum EL that may be accumulated is 300 days.
  • Encashment Limit: Maximum leave encashment allowed at retirement is also strictly capped at 300 days.
  • The 300+15 Rule: If an employee already has 300 days at the end of a half-year, the next 15-day advance credit is kept in a separate account for that half-year. This permits leave during that half-year without instantly losing the advance credit.
2

Commuted Leave and Half Pay Leave (HPL)

Core Principle/Rule: Commuted Leave converts Half Pay Leave into full-pay leave, strictly on medical or approved study grounds, by debiting the HPL account at double the rate.

Key Facts:

  • Credit Rate: HPL is credited at 20 days per year—10 days in advance on 1 January and 1 July.
  • Accumulation Limit: Unlike EL, there is no maximum limit for accumulation of HPL.
  • Commutation Mechanics: When one day of Commuted Leave is taken, two days are debited from the HPL account.
  • Without Medical Certificate: A maximum of 90 days of commuted leave may be granted during the entire service without a medical certificate, but only for an approved course of study certified to be in the public interest.
3

Casual Leave (CL) and Leave Combination Rules

Core Principle/Rule: Casual Leave is strictly an administrative concession, not a recognized “leave” under the formal CCS (Leave) Rules 1972. Because of this status, it cannot be combined with formal statutory leave.

Key Facts:

  • Entitlement: Maximum CL is generally 8 days in a calendar year for Central Government employees.
  • Combination Prohibition: CL cannot be combined with Earned Leave, Half Pay Leave, Commuted Leave, Extraordinary Leave, or Joining Time under any circumstances.
  • Permissible Combinations: CL may be combined with restricted holidays, Sundays, or regular gazetted holidays.
4

Central Services (Medical Attendance) Rules, 1944

Core Principle/Rule: The CS(MA) Rules provide medical reimbursement for Central Government employees stationed in areas not covered by the Central Government Health Scheme (CGHS).

Key Facts:

  • Applicability: These rules do not apply to Railway employees, All India Services officers (who have separate AIS rules), or employees residing in CGHS-covered cities.
  • Authorized Medical Attendant (AMA): Medical attendance must be certified by an AMA, whose grade is determined by the employee’s pay scale.
  • Claim Timeline: The general time limit for submitting medical reimbursement claims is 6 months from completion of treatment.
