Pay Fixation on Promotion (FR 22)

Core Principle/Rule: FR 22(I)(a)(1) ensures that a government servant receives a tangible financial benefit when promoted or appointed to a post carrying higher responsibilities.

Key Facts:

  • The Increment Rule: On promotion, pay is first increased by granting one notional increment in the current lower pay level, then fixed at the next higher cell in the promoted pay level.
  • The Option Window: The employee may choose fixation either directly from the date of promotion or defer it to the Date of Next Increment (DNI) in the lower post.
  • Time Limit: The option must be exercised strictly within one month from the promotion order.
2

Qualifying Service for Increments (FR 26)

Core Principle/Rule: Annual increments are earned through qualifying duty and approved leave; certain unapproved absence delays the increment cycle.

Key Facts:

  • Uniform Dates: Under the 7th CPC, the only increment dates are 1 January and 1 July.
  • Minimum Service: At least 6 months of qualifying service must be completed before the increment date.
  • Impact of Extraordinary Leave: EOL on a Medical Certificate counts as qualifying service. EOL for private affairs without a medical certificate does not count and postpones the increment date.
3

Joining Time Rules (Transfers in Public Interest)

Core Principle/Rule: Joining time is an administrative concession allowing government servants to travel and transition when transferred in the public interest from one station to another.

Key Facts:

  • Same Station (Under 20 km): Where transfer is within the same station or the new headquarters is less than 20 km away, joining time is strictly 1 day, with no travel time.
  • Unutilized Joining Time: If the employee joins early, all unutilized joining-time days are credited to Earned Leave, subject to the overall 300-day EL cap.
  • Transfers on Request: Joining time is not admissible for transfers at the employee’s own request; only regular transit time is allowed and treated as regular leave.
4

Officiating Service and Substantive Pay (FR 9 & FR 35)

Core Principle/Rule: Holding a post substantively means owning a permanent lien on it; officiating means temporarily performing a post’s duties while holding a lien elsewhere.

Key Facts:

  • Double Lien Prohibition: A government servant cannot be appointed substantively to two permanent posts at the same time.
  • FR 35 — Restriction of Pay: The President or Competent Authority may restrict an officiating government servant’s pay to an amount below the minimum of the higher post’s time-scale if the employee has not assumed its full duties and responsibilities.
